Representation of individuals in Chapter 7 and Chapter 13 consumer
(non-business) bankruptcy. Chapter 7 is the cancellation of all eligible
unsecured debt. Chapter 13 is a debt repayment plan that stops
foreclosure and repossessions. It allows past-due amounts to be paid
over 3-5 years in certain circumstances.
Representation of individuals being sued for foreclosure and the use of
Chapter 13 to stop foreclosures and repossessions.
Representation of consumers under the Truth In Lending Act, the Fair
Debt Collection Practices Act, and the Wisconsin Consumer Act.
Certain written notices are required to be given under the new bankruptcy
law before providing bankruptcy advice. I prefer to provide these notices in
person. In addition, in order to provide any meaningful advice, I need to
know a person's assets, liabilities, income and expenses, so I do not
conduct any initial bankruptcy consultations by phone or email.
