I have practiced law in Oshkosh, Wisconsin, as a bankruptcy attorney for
over 20 years. I represent debtors (those filing bankruptcy) under
Chapters 7 and 13. In addition, I represent individuals losing their
homes in foreclosure actions and individuals who have claims under
consumer laws such as the Wisconsin Consumer Act and the Federal
Fair Debt Collection Practices Act.
I am a member of the Bankruptcy, Insolvency, and Creditors' Rights
section of the State Bar of Wisconsin and also service on its Board of
Directors. I am a member of the Winnebago County Bar Association;
the American Bankruptcy Institute; the National Association of Consumer
Bankruptcy Attorneys; the National Association of Consumer Attorneys;
and am an associate member of the National Association of Chapter 13
Trustees.
Areas of Practice....
- Representation of individuals in consumer Chapter 7 and
Chapter 13 bankruptcy proceedings;
- Representation of consumers being sued for foreclosure of their
homes;
- Representation of consumers under the Fair Debt Collection
Practices Act, Truth in Lending Act (TILA), the Real Estate
Settlement Procedures Act (RESPA), and the Wisconsin
Consumer Act.
*A Debt Relief Agency. I counsel and assist clients in obtaining relief from their debts under the Bankruptcy
Code.
The Bankruptcy Reform Act or the Bankruptcy Abuse Protection and Consumer Protection Act went into effect
on October 17, 2005. Bankruptcy as we knew it has changed, but, the option has not been eliminated.
Some significant changes are:
- Every individual debtor has to provide a certificate that he/she has attended a credit briefing through a
credit counseling agency approved by the United States Trustee. This certificate must be filed with
the bankruptcy petition.
- Annual income determines whether one is eligible for Ch. 7 (debt cancellation) or Chapter 13 (a debt
repayment plan). Annual income is determined by averaging the monthly income for the 6 months
prior to the bankruptcy filing and multiplying by 12. This is called the Current Monthly Income (CMI).
- Attorneys and other agencies/individuals who provide bankruptcy assistance must designate
themselves a Debt Relief Agencies (DRAs).
